GENERAL CONDITIONS FOR THE HIRING OF PLANT

The period of hire commences at the time the equipment leaves our premises and ceases at the time it is returned.

The equipment includes the machinery and all tools as described on the hire contract, including handbooks and other items supplied with it. A week is five consecutive days, and a day is 24 consecutive hours. Part of a day will be charged as a full day. We do charge a minimum of 5 days hire standard.

Equipment always remains vested in us, and we may terminate the hiring and retake possession of it without notice in the event of the hirer being in default of any of the conditions of this contract, his committing an act of bankruptcy or calling a meeting for the purposes of Section 293 Companies Act 1948, or if distress or execution is levied or threatened against his property.

The hirer hereby authorises us to enter upon his property for this purpose. The hirer shall pay the hire charge and deposit in advance unless otherwise agreed. If the hirer wishes to extend the period of hire beyond that for which he has paid the hire charge in advance (the initial hire period) he must notify us before the termination of the initial hire period and, if we agree to the continuation of the hiring, the hirer shall pay on demand any additional hire charge.

The hirer acknowledges that the equipment is supplied in good condition but without any warranty as to its fitness for any particular purpose. The hirer is responsible for any damage to the equipment during the period of hire (fair wear and tear excepted) whether caused by the negligence by the hirer or otherwise and indemnifies us against the full cost of repairs or replacement in the event of loss or irreparable damage and shall be liable to continue to pay the hire charge until the repairs have been completed or the equipment replaced.

The hirer may not carry out repairs to or interfere with the equipment, nor allow third parties to do so, we shall not be liable for any damage, injury or loss which may be caused by the equipment whether by a defect therein or otherwise during the period of hire. The hirer shall not part with possession of the equipment without our prior consent during the period of hire and shall always keep us informed of its whereabouts. We recommend the hirer to insure the equipment during the period of hire against loss or damage by accident, fire, and theft to its full replacement value.

Charges for delivery and collection of the equipment are not included in the hire charge.
